Terms of Service

These Terms of Service (“Terms”) govern your access to and use of BullionTree's website, buyer marketplace, dealer portal, admin tools, mobile app, and any related service (collectively, the “Service”), operated by BullionTree (“BullionTree,” “we,” “us,” or “our”). By using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

1. What BullionTree Is, and Isn't

BullionTree is a dealer-neutral marketplace that helps buyers compare offers for physical gold, silver, platinum, and palladium bullion from independent, vetted dealers. BullionTree is not a dealer. We never buy, sell, hold, or take custody of physical bullion, and we are not a party to any purchase you make. Every transaction is completed directly between you and the dealer you choose, subject to that dealer's own terms, pricing, and policies.

Content on the Service, including spot prices, market commentary, and educational reports, is provided for general informational purposes only and does not constitute investment, financial, legal, or tax advice. You are solely responsible for any decision to buy, sell, or hold bullion.

2. Accounts

Some parts of the Service (such as the dealer portal, admin tools, or a saved buyer/mobile account) require creating an account. You're responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms, provide false information, or engage in fraudulent or abusive activity.

3. Buyer Use of the Service

When you submit a quote request, you authorize BullionTree to route the details of that request to dealers who may be a good fit. You agree to provide accurate information and to use the Service only for genuine purchase inquiries, not to harass dealers, scrape pricing data, or otherwise abuse the matching system. BullionTree does not guarantee that any dealer will respond, that a quote will be available, or that any quoted price will be honored by the dealer. Final pricing and terms are set entirely by the dealer.

4. Dealer Use of the Service

Dealers using the dealer portal represent that they are a legitimate, properly licensed business authorized to sell bullion in the jurisdictions they serve. Dealer participation is subject to BullionTree's approval, ongoing performance standards, and any applicable subscription plan and fees, which are billed through our payment processor and described at the time of subscription. BullionTree may adjust routing, suspend, or remove a dealer from the marketplace at its discretion, including for non-payment, policy violations, or poor buyer outcomes.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms;
• Attempt to bypass, disable, or interfere with security features (including bot-protection or rate-limiting controls);
• Submit false, misleading, or fraudulent information;
• Scrape, harvest, or systematically extract data from the Service without our written permission;
• Interfere with or disrupt the integrity or performance of the Service.

6. Intellectual Property

The Service, including its design, text, graphics, and underlying software, is owned by BullionTree or its licensors and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service except as necessary to use it for its intended purpose.

7. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. BULLIONTREE DOES NOT WARRANT THAT SPOT PRICES, DEALER QUOTES, OR ANY OTHER CONTENT ON THE SERVICE IS ACCURATE, COMPLETE, OR CURRENT, OR THAT ANY DEALER IS RELIABLE, LICENSED, OR WILL HONOR A QUOTED PRICE.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BULLIONTREE AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR ANY TRANSACTION WITH A DEALER, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BULLIONTREE'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

9. Disputes With Dealers

Because BullionTree is not a party to any transaction between you and a dealer, any dispute regarding pricing, product condition, shipping, payment, or fulfillment is between you and that dealer. BullionTree may, at its discretion, assist in facilitating communication but has no obligation to resolve such disputes.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users, dealers, or BullionTree.

11. Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles, and any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Illinois, unless otherwise required by applicable law.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we'll update the “Last updated” date above. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
